Terms And Conditions for Glam Gang Campaign

  1. These terms and conditions (the “T&C’s”) apply to the Glam Gang Campaign (hereinafter referred to as “Campaign”) for consumers, which is sponsored and brought to you by Philips India Limited (hereinafter referred to as “Philips”) and conducted by 4 Minute Mile Marketing Services Pvt. Ltd. (hereinafter referred to as “Campaign Partner”) and hosted on the platform of www.shop.philips.co.in operated by Analemma Commerce Private Limited (hereinafter referred to as “Analemma”).
  2. Analemma shall conduct a Campaign on the platform as stated above wherein Participant (s) can participate by filing their details. Participation is voluntary.
  3. Philips reserves all rights to change, modify or alter these T&Cs at any point of time. These T&C constitute the comprehensive T&C of the Campaign and all Participant(s) are bound to comply with the same. Any non-compliance with the same may disqualify the Participant(s) from participating in the Campaign. Philips reserves the right to alter these T&Cs without any further notice as Philips may deem fit in its sole and absolute discretion. No communications/correspondences will be entertained by Philips on account of the aforementioned alterations/ modifications or otherwise.
  4. Participant(s) shall be deemed to have a notice of any such amendments or interpretations upon publication of the same on the domain and shall be deemed to have accepted such amendments or interpretations by virtue of his/ her continued participation in this Campaign. If a Participant does not wish to continue to participate in this Campaign pursuant to the prevailing T&C as amended or interpreted, he/she may terminate participation in this Campaign upon written notice to Campaign Partner via email on customercare@4mm.co.in Monday – Friday 10am to 6:30pm / Saturday 10am to 2pm) only excluding public/bank holidays.
  5. All decisions of Philips in any matter under these T&Cs shall be final and no discussion or correspondence will be entertained.
  6. A failure by Philips to enforce any of these T&Cs in any instances will not give rise to any claim by any person.
  7. Nothing herein amounts to a commitment or representation by Philips to conduct further similar or other Campaigns.
  8. This is an electronic document and does not require any digital or physical signature.
  9. The Campaign period starts from 21st August 2023 and shall continue for a term at the discretion of Philips. Philips may in its absolute discretion curtail or extend the Campaign period, as it may deem necessary. Philips shall declare every month (3) three lucky winners of this Campaign. For avoidance of doubt, it is hereby clarified that Philips have the absolute discretion to change the frequency of declaring the winners and the number of winners.
  10. The participation in the Campaign will be considered as valid only if the Participant is resident of India, is a woman aged above eighteen (18) years and is in possession of valid identity document. Employees of Philips India Limited and their families are not eligible to participate in the consumer offer.
  11. The (three) 3 lucky winners who get a chance to star in Philips Influencer Video along with the social media beauty influencers chosen by Philips. It is hereby clarified that the social media beauty influencers will be chosen at the discretion of Philips and the Participants does not have the right to choose the social media beauty influencers.
  12. The winner selection process for chance to star in Philips Influencer Video along with the social media beauty influencers will be as follows:
  13. The three (3) lucky winners shall be shooting/recoding a video with social media beauty influencer. The aforesaid shooting/recoding shall be facilitated by Philips directly or through its agency. It is hereby expressly clarified that the intellectual property rights on the video developed under this campaign shall solely rest with the Philips. The Participant may, at the request of Philips participate in all promotional activity (such as publicity and photography) surrounding the gratification, free of charge, and they consent to Philips for using their name and image in promotional material. Such Participant agrees and consents to Philips to cover the aforesaid Campaign activities through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
  14. Philips will cover return airfare, food and conveyance expenses for this trip, booked by Philips for the lucky winner. Philips reserves the right to record pictures/videos of this trip and experience and use the same to promote on Philips social media/YouTube accounts or any other media platforms.

Please note PHILIPS is not liable under any circumstances for any consumer complaint regarding the Campaign or any issues whatsoever.
  16. These Terms shall be interpreted in accordance with the laws of India. All disputes will be addressed under the jurisdiction of the court in New Delhi only.
  17. The platform of the Campaign may contain links to other websites (Linked Sites). Philips does not endorse and is not responsible for the content of any Linked Sites. Any Linked Sites displayed on the platform are for the Participant’s convenience only and the Participant agrees to access, use and otherwise deal with Linked Sites at their own risk.
  18. In consonance with Analemma’s Privacy Policy (_https://www.shop.philips.co.in/privacy-policy_____________) Participant(s) consent that Analemma may collect, use, process or maintain or have access to Personal Identifiable Information i.e. any information or set of information, whether alone or in combination with other personal information gathered, processed, used or stored by Philips which is sufficient to identify an individual (hereinafter referred to as “PII”) of the Participant(s).
  19. The Participant(s) also acknowledge that Analemma may use and/ or provide PII of the Participant(s) or of any other person as provided by the Participant(s), to the Campaign Partner or Philips from time to time for the purpose of this Campaign or otherwise.
  20. The Participant(s) also acknowledges that he/she shall be personally liable for the disclosure of his or any other person’s PII to Analemma and Analemma shall not be liable for the use of such information by any person. The Participant shall keep Analemma indemnified in this regard.
  21. The mere participation in the Campaign implies the total and unrestricted acceptance and knowledge of these T&C’s, as well as the decisions that Philips may subsequently adopt in relation to any point or issue not foreseen in the same. Participants that do not adhere to the rules or specifications may be disqualified at the sole discretion of Philips. If a Participant uses fraudulent methods or otherwise attempts to circumvent the rules, the Participant may be disqualified at the sole discretion of Philips. Philips reserves the right, at any time, to verify the validity of entries and Participants (including a Participant identity, age and place of residence) and to disqualify any Participant. Failure by Philips to enforce any of its rights at any stage does not constitute a waiver of those rights.
  22. Any costs associated with entering into the Campaign, including accessing the campaign website, are the responsibility of each Participant. Also, regular call and message rates will apply as per the consumer telecom operator in their respective circle.
  23. If this Campaign is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Philips, including but not limited to technical difficulties, unauthorized intervention or fraud, through Campaign Partner, Campaign Partner reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Campaign, as appropriate.
  24. If for any reason this Campaign is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Campaign Partner and/or Philips which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Campaign, Campaign Partner and/or Philips reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.
  25. Caution: Any attempt to deliberately damage platform or the information on the platform, to cause malicious damage or interference with the normal functioning of the platform, or to otherwise undermine the legitimate operation of this Campaign may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Analemma/Philips reserves the right to seek damages to the fullest extent permitted by law. If Analemma/Philips suffers loss or incurs any costs in connection with any breach of these terms or any other legal obligation by a Participant, the Participant agrees to indemnify Analemma/Philips for those losses, damages, and costs.
  26. Philips, Analemma and Campaign Partner are not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to Participant's or any other person's mobile handset or computer related to, or resulting from, participation in this Campaign or the downloading of any materials related to this Campaign.
  27. Campaign Partner, Analemma and Philips accept no responsibility, financial or otherwise for the misuse of Campaign in any way whatsoever and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning this Campaign.
  28. Philips does not assume any responsibility or liability with respect to operational and/or technical aspects of this Campaign, or the services provided by Campaign Partner and or Analemma. Any dispute regarding the services of Campaign Partner must be addressed directly with Campaign Partner.
  29. If the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign.
  30. By participating in this Offer, the Participant unconditionally and irrevocably accepts and agrees to be bound by all these terms and conditions as stated herein without any exception whatsoever.
  31. The decision of Philips Campaign Partner, as regards to the Campaign shall be final. No correspondence or any other claims whatsoever, in this regard will be entertained.
  32. No queries, claims, dispute, complaints or grievances pertaining to the Campaign shall be entertained by Philips and Campaign Partner.
